Trespassing case thrown out; Nevada judge rules casinos do not have the right to eject patrons at will         Originally posted on BJ21.com Green Chip

NORTH LAS VEGAS - In the criminal case from which a public record is linked above, Jerry's Nugget believed the defendant was a brain-using patron. The patron was not disruptive or disorderly. Through attorney Bob Nersesian, the defense to the criminal trespassing charge essentially was that a Nevada casino does NOT have the right to eject a patron without cause, therefore the crime of trespassing did not occur. The Municipal Court Judge agreed. Paragraph 9 is the highlight. Unfortunately, this case has little value as a precedent. But it shows that there are honest judges in Nevada.
